Our Property Management Guarantees

Risk-Free Landlord Experience | Ensuring Your Rental Success

As a Nest Managers owner-client, you can relax and let us handle everything, including one of the biggest risks that a landlord may face: eviction legal fees.  

How can we do this?

Because our screening is so good, and our processes are so tight, we are able offer you this service.

Landlord accounts with Nest Managers must be in good standing and with no violations of the terms of the Residential Management Agreement.

 

Termination of the Residential Management Agreement shall cause enrollment in Risk Mitigation to immediately terminate and Nest Managers shall not be responsible for any claims either past or future.

 

The resident must have been procured by Nest Managers and on a Nest Managers lease agreement with a start date of August 1, 2023 or later.

 

In the event a resident defaults on the payment or rent, Nest Managers will have the sole right and sole discretion to institute legal proceedings for an eviction.

 

All legal fees incurred will first be billed to the resident. Nest Managers will first attempt to collect funds from resident to reimburse owner. If Nest Managers does not collect these funds from resident, then Nest Managers will pay these expenses within the coverage limits stated above.

 

All amounts due from resident for legal fees will first be deducted from the resident's security deposit, and Nest Managers will pay any amount over the security deposit to the maximum payout amount. Nest Managers will have a first claim position against the resident for any payment(s) recovered.

 

The maximum payout by Nest Managers per lease agreement will not exceed $1,000.

 

All payouts by Nest Managers will be made after the resident has vacated the premises and after the completion of the security deposit disposition by Nest Managers.  Any lease fees charged to the resident will be retained by Nest Managers.

 

Our Eviction Protection Guarantee covers the court filing fees, legal representation, and writ costs associated with evictions for tenants we place through our standard market screening process.

Due to additional administrative complexity and legal differences in the eviction process for government-subsidized housing programs (such as Section 8), this guarantee does not extend to tenants placed through these programs. However, we are proud to lease to qualified applicants from all housing programs and remain fully compliant with the Fair Housing Act.

Never pay two leasing fees within a 12-month period for the same unit. We stand behind our screening and the residents we place.

With our full-service management, if a resident breaks their lease during the first lease term, we will replace them at no additional leasing fee. We cover the marketing, listing, showings, application processing, and placement of a new resident — on our time and at our cost.

The only exclusion is when a resident is relocated due to verifiable military PCS orders under SCRA law.

This guarantee applies to residents placed under our standard leasing criteria. Due to legal and administrative requirements associated with government-subsidized housing programs, the Tenant Placement Guarantee may not be available for these placements. However, we remain committed to treating all applicants fairly and in full compliance with local, state, and federal housing laws.

This guarantee applies to voluntary lease breaks or early move-outs only. If eviction proceedings or the Eviction Protection Guarantee are utilized, the Tenant Placement Guarantee does not apply, as those situations are covered separately under the eviction protection program.

Tenant Placement

Your satisfaction matters to us. If you believe Nest Managers has not fulfilled the specific duties outlined in your signed management agreement (see Page 2, Section 6 – Manager Responsibilities), please provide written notice describing the measurable service concerns. We will promptly review the items with you and work to correct them.

If, after a reasonable opportunity to address those concerns, we are unable to resolve a verified performance issue, you may terminate your management agreement with 30 days’ written notice and no penalties.

​

This guarantee applies only to unresolved service failures directly related to the responsibilities defined in the management agreement. It does not apply to decisions unrelated to our performance, such as choosing to self-manage, selling, changes in investment strategy, or personal preferences.

 

Terminations for these reasons remain subject to the standard agreement terms and applicable fees.
